Please read these Terms and Conditions carefully before using any service provided by Bequestly. By enquiring about, engaging, or using our services, you agree to be bound by these terms.

1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

  • "Agreement" — these Terms and Conditions together with any service engagement letter or quote accepted by the Client.
  • "Bequestly", "we", "us", "our" — Bequestly, registered and operating in Bangkok, Thailand, at 156 Surawong Road, Si Phraya, Bang Rak, Bangkok 10500.
  • "Client", "you", "your" — any individual or household that enquires about or engages our services.
  • "Service" — any of the three documentation services offered by Bequestly: the Process Orientation Guide, Document Sorting & Index Service, and Memory & Legacy Documentation.
  • "Output" — any deliverable produced by Bequestly in the course of a Service, including printed booklets, digital files, typed indices, and bound archive volumes.
  • "Documents" — physical or digital materials provided by the Client for handling during a Service engagement.

2. Acceptance of Terms

By submitting an enquiry, signing a service engagement letter, or making a payment to Bequestly, you confirm that:

  • You are at least 18 years of age, or acting with the authority of an adult household member.
  • You have read and understood these Terms and Conditions.
  • You have the legal capacity to enter into a binding agreement under the laws of Thailand.
  • If acting on behalf of a family or household, you have the authority to do so.

3. Service Description

Bequestly provides the following documentary and informational services:

  • Process Orientation Guide (฿3,700): A written guide explaining, in general terms, how inheritance and estate processes are commonly organised in Thailand and where official information is held. Delivered as a printed booklet and digital PDF. Educational only; no advice is given.
  • Document Sorting & Index Service (฿9,200): A practical service sorting family records into a clear system with a typed index and checklist. Purely organisational; no advice is given and all decisions remain with the Client.
  • Memory & Legacy Documentation (฿30,500): A service recording and preserving family memories, photographs, and history in an ordered archive, with a digitisation plan. Documentation only; no advice is given.

All services are available to clients based in Thailand. Remote or postal delivery of Outputs may be arranged at additional cost. Bequestly reserves the right to decline an engagement at its discretion.

4. User Responsibilities

As a Client, you agree to:

  • Provide accurate information about your situation and needs at the time of enquiry and during the engagement.
  • Make Documents available to Bequestly only if you have the legal right to do so and the authority of any family members whose personal data may be contained therein.
  • Not use any Output produced by Bequestly as a substitute for qualified legal, financial, or tax advice.
  • Not represent any Output as official legal documentation or as advice from Bequestly.
  • Not request Bequestly to produce content that would constitute legal, financial, or estate advice.
  • Treat all information shared by Bequestly's team as confidential business information and not disclose it to third parties without our written consent.

5. Intellectual Property

All template structures, methodologies, index formats, and guide frameworks used by Bequestly are the intellectual property of Bequestly.

Upon full payment, Bequestly grants the Client a non-exclusive, non-transferable licence to use the Output produced specifically for their engagement for personal and family purposes. This licence does not permit:

  • Commercial use or resale of any Output.
  • Reproduction or distribution of Bequestly's template structures or guide formats.
  • Modification of any Output in a way that misrepresents its source or nature.

Personal family content (photographs, written memories, family history) recorded during a Memory & Legacy Documentation engagement remains the property of the Client at all times.

6. Payment Terms

All prices are as listed and denominated in Thai Baht (฿). Bequestly's published prices are inclusive of all fees for the stated service scope.

  • Payment schedule: A 50% deposit is due on confirmation of engagement. The remaining balance is due on completion, prior to delivery of the Output.
  • Payment methods: Bank transfer to Bequestly's nominated account, or such other methods as stated in the engagement letter.
  • Cancellation: If the Client cancels after work has commenced, the deposit is non-refundable. If Bequestly is unable to complete the service for reasons within its control, a full refund will be issued.
  • Scope changes: Any material change to the scope of a service, agreed in writing by both parties, may result in a revised price.

7. Service Delivery Terms

  • Timeline: Indicative timelines are provided at the outset of each engagement. These are estimates and may vary depending on the volume of materials and the Client's availability.
  • Document handling: All original Documents provided to Bequestly will be handled with care and returned to the Client on completion of the engagement or on request at any point.
  • No retained copies: Bequestly will not retain physical or digital copies of the Client's personal Documents without explicit written consent.
  • Confidentiality: All Client information and Documents are treated as strictly confidential and will not be shared with any third party except as required by Thai law.
  • Non-advisory boundary: No element of any Bequestly Service constitutes legal, financial, tax, or estate-planning advice. Clients requiring such advice should engage a qualified professional.

8. Disclaimers

Bequestly's services are provided on an informational and organisational basis only. To the fullest extent permitted by Thai law:

  • Bequestly makes no representation that any Output is complete, current, or free from error.
  • Information in the Process Orientation Guide reflects general public information at the time of production and may not reflect subsequent changes in Thai law or official processes.
  • No Output produced by Bequestly should be relied upon as legal documentation, legal advice, or professional guidance of any kind.
  • Bequestly does not warrant that use of its services will result in any specific legal, financial, or administrative outcome for the Client.

9. Limitation of Liability

To the fullest extent permitted under the laws of Thailand:

  • Bequestly's total liability to any Client for any claim arising from a Service engagement shall not exceed the total fees paid by the Client for that engagement.
  • Bequestly shall not be liable for any indirect, consequential, or special damages, including loss of income, loss of opportunity, or damage arising from reliance on any Output.
  • Bequestly shall not be liable for any damage to Documents caused by circumstances beyond its reasonable control, including force majeure events.

10. Indemnification

You agree to indemnify and hold harmless Bequestly, its directors, staff, and representatives from and against any claims, losses, or expenses (including reasonable legal fees) arising from: your misuse of any Output; your breach of these Terms; or any claim by a third party arising from your use of our services, including any claim that Documents provided to us were supplied without proper authority.

11. Termination

  • By the Client: You may end an engagement at any time by written notice. Payment obligations for work already completed will apply as set out in Section 6.
  • By Bequestly: We may suspend or terminate an engagement if you breach these Terms, fail to make payment, or behave in a way that is abusive toward our staff. In such cases, fees for work already completed are retained.
  • Effect of termination: On termination, all Documents will be returned to you. Any Output completed up to the point of termination will be delivered on receipt of payment for work done.
  • Survival: Sections 8, 9, 10, 12, and 13 survive termination of this Agreement.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Both parties agree to the exclusive jurisdiction of the courts of Bangkok, Thailand.

Informal resolution: Before initiating any formal legal process, either party may request a meeting or written exchange to attempt to resolve the matter within 30 days.

Consumer protection rights under Thai law, including those under the Consumer Protection Act B.E. 2522, are not affected by these Terms.

13. General Provisions

  • Entire agreement: These Terms, together with any accepted service engagement letter, constitute the entire agreement between you and Bequestly for the relevant service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure by Bequestly to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. Bequestly may assign its obligations to a successor entity.
  • Notices: Formal notices should be sent to [email protected] or to our registered address.

14. Changes to These Terms

Bequestly may update these Terms from time to time. Material changes will be posted on our website with an updated effective date. Continued use of our services after the effective date of any change constitutes acceptance of the revised Terms. For active engagements, the Terms in effect at the time of the engagement letter will apply unless both parties agree otherwise in writing.
